I currently only have the iphone 3G. I'll probably be waiting till apple announce the date/release of the next one and sidestep the 3gs all together, just not worth finding that level of cash/contract for what it has which would only be the video feature in my mind. But it was nice to get an email from bambuser with a developer for beta testing version with the same kind of method enabled. I think the standard iphone 3G probably is a little too slow and the iphone 3GS will perform better. Weird, i still never think of the iphone as a videoblogging device really yet. Some of the new android ones look tasty!

Testing Posterous here. Seems clean and neat. Just type in your name and you are good to go. Nice. I like it. Though I can't see how u post pics and audio files from here - are they through E-Mail attachments only?

競合社に一斉転職は背信 東京地裁、退職金認めず

 有線最大手USEN(東京)の関連会社に一斉転職した競合社キャンシステム(同)の元従業員約300人が、会社側に退職金を求めた訴訟の判決で、東京地裁は28日、25人以外の請求を棄却した。

 白石哲裁判長は「全国規模で一斉退職すれば、会社の業務が完全にまひ、停止すると認識しながら、あえて示し合わせて退職届を出しており、会社への著しい背信的行為だ」と指摘。従業員らを懲戒解雇としたキャン社の処分は有効として、退職金を支払う必要はないとした。

一斉退職は会社への背信行為を共謀したことにあたり、懲戒解雇が正当化されるそうだ。退職金が出る25人については、退職時期がずれているということと業務引継をやったということから懲戒解雇には相当しないそう。

 ファイル共有ソフト「Winny(ウィニー)」を開発、インターネットで公開し、利用者によるゲームソフトなどの違法コピーを助けたとして著作権法違反(公衆送信権の侵害)のほう助罪に問われた元東京大大学院助手・金子勇被告(39)の控訴審判決が8日、大阪高裁であった。

 小倉正三裁判長は「被告に積極的な著作権侵害の意思はなく、ほう助罪は適用できない」などとして、罰金150万円とした1審・京都地裁の有罪判決を破棄し、逆転無罪を言い渡した。

 2006年12月の1審判決によると、金子被告はウィニーが著作権侵害に使われていることを知りながら、03年9月、最新版をネットで公開。同月、松山市の男性と群馬県高崎市の男性(いずれも著作権法違反で有罪確定)が計28本のゲームソフトや映画をネットに公開するのを手助けした。

 最大の争点は、著作権侵害の認識の有無だった。

Es wird mal wieder Zeit über meine Fortschritte in meinem neuesten Hobby Modellbau zu berichten. Ich hatte jetzt ja lange Zeit Spaß mit meinem Reely Sturdy Buggy vom großen C. Da er das Chassis von Tamiya's Baja King als Grundlage hatte, war es bis jetzt immer sehr leicht Reparaturen und Umbauten selbst durchzuführen. 

Je mehr ich ihn allerdings getuned habe, desto schwieriger wurde das Gelände und desto weiter wurden die Sprünge. Vorletzte Woche hatte ich zwar dann eine Menge Spaß, aber am Ende war der Buggy wieder ein Fall für eine Runderneuerung. Und genau da hab ich angefangen zu überlegen, was ich wirklich machen will. Einfach auf Kies und Dreck rum zu heizen war schon gut, aber irgendwie auch nicht das Non-Plus-Ultra. Weil ich auch für Rennen keine Zeit habe und auch (noch) nicht den Platz für nen Monster Truck wie den Savage Flux, habe ich mich dazu entschlossen aus meinem vorhandenen Buggy ein Trial Fahrzeug zu machen.

Letzte Woche habe ich also damit verbracht zu recherchieren und heute Abend konnte ich schon den Großteil der Umbauten fertigstellen. Schritt 1 war bestand darin alle Aufhängungen zu verstärken. Als Schritt 2 habe ich mir neue Reifen ausgesucht. Es wurden die weicheren Crawler Reifen von Tamiya's CR-01 Bausätzen und dazu die schwarzen Felgen mit der leichten Spurverbreiterung. Als letzten größeren Punkt habe ich mich bei meinem Modellbau-Händler ums Eck einen neuen wasserdichten Regler, den Carson Zoom Cup, geholt. Dazu gab es noch einen Graupner Speed 600 Motor mit ca 13.000 Umdrehungen pro Minute. 

Bin schon gespannt, wie sich diese Kombination im Gelände macht. Am Montag sollte ich Zeit für eine erste Testfahrt haben!

And maybe this could be my blog. I do have one at http://blog.kemryu.com/ but its something I use so rarely from a mix of lack of creativity and a dislike of many user interfaces. In the words of Nguyen, "I am thinking of using a more generic version like the default design of posterous which is a great service" (Update: just to add to Long's comment down below) [ Posterous' small selection of themes and ability to customize them have been so well implemented that they don't hinder the service in anyway. It moves slowly, but surely. ] — a great service because of its dead simple concept (that I wish I would of thought of) of using your preferred email service as the posting form.

We shall see soon enough if this becomes a viable pulse.

James Orr put an immediate halt to his criminal trial Wednesday when he squeezed the contents of his colostomy bag onto the table in front of him and ate it.

"There was what appeared to be feces on the table and on the floor," assistant Hamilton County prosecutor David Prem said.

Prem was prosecuting Orr, 66, for robbery and kidnapping. The trial, without a jury before Common Pleas Court Judge Ethna Cooper, began last week but continued today.

A witness had just taken the stand in the case Wednesday when Norm Aubin, Orr's attorney, said Orr leaned into him and asked if Aubin had anything to eat.

A shocked Aubin said he didn't. Orr then said he was hungry and asked for food. Aubin ignored him.

That's when Orr made a spectacle of taking his colostomy bag, worn on the outside of his body to collect his waste, and placing it on the table. He then squeezed it and looked to be eating it.

"It appeared he was eating his own (feces) at the table," Aubin said.

The Sheriff's deputy in the room shouted "What are you doing?" and then cuffed Orr and rushed him out of the courtroom.

The Sheriff's office later reported there was feces on Orr's lips, beard, hands and the defense table where he was sitting.

The judge suggested the courtroom had become a biohazard area and closed it for cleaning, continuing Orr's trial until next week.

Prem admitted he almost vomited up while watching Orr's antics but suspects they were done with a purpose.

"He's a con man. He has over 50 aliases and has convictions in Ohio and New York for thefts and robberies," Prem said.

"He's done just about everything a person can do to avoid justice. He feigned (mental) incompetence" leading up to this trial, Prem said.

Orr was ordered to trial after court mental health workers deemed him mentally sound and a faker.

"I'm completely convinced his whole goal here is to cause as much mayhem as he can," Prem said of Orr.

Aubin will have jail workers again check Orr's mental health before continuing the trial Wednesday.

No additional charges were filed against Orr after Wednesday's courtroom activity.

Orr was being tried for robbery and kidnapping charges after officials said Orr and a partner tried to get money, in a ruse, from a woman buying food at a Silverton Chinese restaurant. When the woman wasn't fooled, Orr is accused of pulling a gun on her - with her three children in the car outside - and taking her to a bank where she was forced to withdraw $1,000 and give it to Orr. He faces more than 60 years in prison on those charges.
